CONDITIONS GENERALES D´UTILISATION
These general conditions of sale apply to all transport contracts concluded with Mola et Fils for the cross-border transport of goods, transhipment and storage of shipments, unless mandatory legal provisions, in particular those of the French Commercial Code (HGB), the Convention on the Contract for the International Carriage of Goods by Road (CMR), the Montreal Convention (MÜ) or the Warsaw Convention (WA), are contrary to these conditions.
Any diverging general business conditions of customers that Mola et Fils does not explicitly accept in writing cannot bind Mola et Fils, even if Mola et Fils does not formally contest them again.
The place of collection of packages is the address of one of our warehouses in Lomé. Mola et Fils does not go from house to house to collect parcels.
The customer is required to make the goods available to Mola et Fils, ready to be dispatched and to deliver his package to one of our warehouses in Togo. In this regard, the customer assumes sole responsibility for packaging the goods shipped in such a way that they are suitable for transport and storage.
Comments on the packaging requiring special handling of the goods do not bind Mola et Fils and do not release the customer from the obligation to provide packaging that is safe for transport and suitable for storage.
Mola et Fils is not required to check the packaging or the contents but may refuse to accept a shipment if it is evident that it is not securely packaged for transport or if it has doubts about the contents of the cargo. Similarly, Mola et Fils is exempt from liability to the extent that loss, damage or exceeding the delivery time are due to insufficient packaging and labeling on the part of the sender.
At the request of Mola et Fils, the customer is obliged to give instructions to Mola et Fils in the event that a shipment is not delivered. In the absence of instructions from the customer, Mola et Fils will be entitled to invoice the customer for the costs incurred for temporary storage.
The importation of certain goods is, because of their sensitive nature, subject to circulation restrictions or strictly prohibited.
Money, papers with monetary value (cheques, securities, bills of exchange, savings accounts), credit cards, prepaid cards and telephone cards).
precious metals, jewellery, watches, grandfather clocks, genuine pearls, precious stones, furs, works of art, paintings, antiques, medicines.
live animals, human and animal remains, organs and parts of corpses, urns
Weapons as defined by Togolese law, African States and European Union States, ammunition as well as weapons or weapon components that violate the legal provisions of the country of departure or destination.
Dangerous goods, waste within the meaning of the law on the promotion of closed loop waste management as well as any type of consignments containing oil, gasoline, lubricants, gas cylinders, oxygen and compressed air with or without filling, explosive objects.
All goods that still contain liquids (eg engines, gearboxes, machines, etc.) Residual liquids from the goods to be shipped must also be disposed of without leaving any residue.
Any goods that violate the destination country's import regulations, embargo lists and anti-terrorism regulations.
Any goods which, themselves or their carriage, violate a legal or official prohibition.
Temperature-sensitive products such as musical instruments (pianos), plants, fruits, perishable foodstuffs.
Mola et Fils is liable for damage caused by loss of or damage to the goods during the period from acceptance for storage to delivery, unless the damage could not have been avoided by the diligence of a careful businessman.
The liability of Mola et Fils in the event of loss of goods is limited to the height of the transport price of the package transported.
Any product seized by customs on dispatch or receipt is not the responsibility of Mola et Fils. No costs will be refunded in this case!
Due to the Corona pandemic and the resulting official and economic restrictions, it is possible that the delivery of the transport you have ordered may be compromised.
Mola et fils is released from any obligation if the client fails to comply with any of the aforementioned bases. All costs relating to legal action in the event of non-compliance with transport regulations are borne by the sender and the recipient.
